Mother blames defective product for son's death

Preparing for the arrival of a new baby is exciting. From decorating the nursery to purchasing helpful baby gear, Tennessee parents usually do their very best to make the safest possible choices. Discovering a defective product hiding in a child's room can be terrifying and even deadly.

An out-of-state mother claims that there are many unsafe baby products still available for sale all across the United States. Inclined sleepers are popular products despite being linked to the deaths of dozens of babies. The Consumer Product Safety Commission has recalled millions of inclined sleepers manufactured by five different companies, but many other companies have avoided recalls. One such company is Chicco U.S.A., which sells an inclined sleeper called the Playard nappers.

According to the woman, the Playard nappers are defective. Her 3-month-old son died from asphyxiation while sleeping in the product. This is not a problem unique to Chicco's product, either. Inclined sleepers make it easy for babies' heads to tip forward so their chins rest against their chests, which can lead to asphyxiation in infants. Chicco has denied that the inclined sleeper is defective.

Tennessee consumers expect companies to provide the safest possible products. Unfortunately, few products have to comply with government safety standards, so safety investigations usually only occur after young children have already been hurt or even killed. If a company designs, manufactures or sells a defective product, it is possible to pursue compensation through a civil lawsuit. A victim may be able to achieve compensation while also affecting change that can protect others in the future.
